The Final Rule was released on time this year, November 2. As is often the case, there is something for everyone to object to in the rule.
First, the conversion factor decreases $1.30 to $33.59. But, CMS also clarifies its position on split/shared visits involving a physician and non-physician practitioner for 2022 and 2023. For critical care, CMS is adopting the CPT book’s language for critical care services. In a relief to surgical practices, they are allowing critical care services in the post-op period that are unrelated to the surgery. This is the current rule. CMS is developing new modifiers for split/shared and for post-op services. There is a clarification (not a policy change) to the the Teaching Physician rules about using time to select E/M services.
